Terms of Service

The core terms governing use of AfroFusionPlate website and services.

1. Acceptance

These Terms of Service apply when you access the AfroFusionPlate website or purchase or use our meal subscriptions, delivery, catering, Academy or NDIS-related services. By creating an account, placing an order, making a booking or otherwise using a paid service, you agree to these Terms and any service-specific terms presented to you.

If you are acting for another person, you confirm that you are authorised to do so. If a participant is under 18 or cannot legally agree for themselves, a parent, guardian or authorised representative must agree where required.

2. Services

AfroFusionPlate provides African-inspired chef-prepared meals, recurring meal plans, delivery to eligible locations, catering, cooking and skills activities through AfroFusionPlate Academy, and NDIS-related supports within our applicable service and registration scope.

Availability can depend on postcode, menu rotation, stock, delivery capacity, booking availability, participant needs and service suitability.

3. Accounts

You must provide accurate information and keep account details current. You are responsible for maintaining the confidentiality of login credentials and verification codes. You must tell us promptly if you suspect unauthorised access or misuse of your account.

4. Orders and subscriptions

Meal plans are recurring and may be offered weekly or fortnightly. The plan price, frequency, inclusions, delivery fees and applicable cut-off will be shown before purchase or in your account. A recurring subscription continues until paused, skipped or cancelled in accordance with the applicable cut-off and these Terms.

You may select meals subject to menu availability. We may update rotating menus or make reasonable substitutions where an item becomes unavailable, taking into account declared dietary requirements where reasonably practicable.

5. Prices and payments

Prices are displayed in Australian dollars unless stated otherwise. Payment is processed through Stripe. By submitting payment details, you authorise Stripe and AfroFusionPlate to process the payment for the order or recurring plan you selected.

For recurring plans, charges occur according to the disclosed billing cycle. If a payment fails, we may retry the payment, contact you, pause fulfilment or cancel the affected order or subscription after reasonable attempts to resolve the failure.

We may change prices prospectively. If a price increase will apply to an existing recurring subscription, we will provide reasonable notice before the increased price is charged and you may cancel before it takes effect.

6. Delivery

Delivery is available only to eligible locations confirmed by postcode or other availability checks. AfroFusionPlate uses Be Cool Refrigerated Couriers for refrigerated/frozen meal delivery. Delivery dates and windows are estimates and may be affected by courier operations, traffic, weather, emergencies, public holidays or other circumstances outside our reasonable control.

You must provide a complete and accurate delivery address and any safe-place instructions. If you authorise a delivery to be left unattended, responsibility for timely collection and correct storage passes to you once delivery has been completed at the nominated location, subject to rights that cannot lawfully be excluded.

7. Frozen food, storage and heating

Meals are freshly prepared and frozen for delivery. Place meals in the freezer promptly upon receipt and store frozen at approximately -18°C unless the product label states otherwise. Meals are best consumed within the period stated on the product or website, and customers should follow meal-specific label directions for thawing, heating, storage and consumption.

Do not consume food that appears damaged, improperly sealed, unsafe or outside applicable storage instructions. Contact us promptly if you have concerns about a delivery or product condition.

8. Allergens and dietary requirements

We provide ingredient and dietary information to help customers make informed choices. Customers with allergies or special dietary requirements should review the relevant product information and contact us before ordering where necessary. While we take reasonable steps to manage allergens, cross-contact may be possible unless a specific product statement expressly says otherwise.

9. Cancellations, pauses and changes

You may pause, skip, modify or cancel a recurring meal plan using the available account process or by contacting us, provided the request is received before the applicable cut-off for the next order cycle. Current customer-facing information may specify a Wednesday cut-off for the following week; the cut-off shown in your account or order flow at the time of the request applies.

Catering, Academy and NDIS services may have separate booking, cancellation, service-agreement or quote terms.

10. Refunds and Australian Consumer Law

Because food products are perishable, we do not provide change-of-mind refunds after an order has entered preparation, dispatch or delivery unless we expressly agree otherwise. This does not limit any right or remedy you have under the Australian Consumer Law.

If goods or services have a problem, are not provided with due care and skill, do not match their description, are unsafe, or otherwise fail a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law. 11. NDIS services

NDIS-related services are subject to service suitability, our current provider registration or service scope, the participant’s goals and plan, applicable NDIS pricing and claiming rules, and any service agreement. The presence of an NDIS-related service on the website does not mean every meal, product, catering order or Academy activity is automatically claimable from NDIS funding.

12. Communications

We may use Ozibus to send email, SMS delivery-status messages, phone-number verification and OTP/security messages. Marketing email is optional and may be unsubscribed from at any time. Transactional, security and service messages may continue where reasonably necessary to provide a service you requested or protect your account.

13. Intellectual property and website use

Website content, branding, photographs, recipes, text, graphics and other materials are owned by or licensed to AfroFusionPlate unless stated otherwise. You may use the website for personal, lawful purposes but must not copy, scrape, reverse engineer, interfere with or commercially exploit website content except as permitted by law or with our written consent.

14. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. To the extent permitted by law, we are not responsible for loss caused by customer misuse, failure to follow storage or heating instructions, inaccurate delivery information, unauthorised account use caused by the customer, or events outside our reasonable control.

15. Changes and governing law

We may update these Terms prospectively. Material changes affecting an active recurring service will be communicated reasonably before they apply where required. These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth law. Courts and tribunals with jurisdiction may hear disputes.
