Please read these terms carefully before using our services

1. Introduction

Welcome to AfroFusionPlate ("we," "our," or "us"). These Terms of Service govern your use of the AfroFusionPlate website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Important: These Terms contain important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that might apply to you. Please read them carefully.

If you do not agree with any part of these Terms, you may not use our Services. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. Account Registration

To access certain features of our Services, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately if you discover or suspect any security breaches
  • Take responsibility for all activities that occur under your account

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are of legal age to form a binding contract.

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or misleading.

3. Meal Subscriptions

AfroFusionPlate offers various meal subscription plans. By subscribing to a plan, you agree to the following:

3.1 Subscription Plans

We offer several subscription tiers with different features, meal quantities, and pricing. You may change your subscription plan at any time through your account settings, with changes taking effect at the start of your next billing cycle.

3.2 Meal Selection

Subscribers can select meals from our weekly menu. Meal selection deadlines are specified in your account and may vary based on your delivery schedule. If you do not make selections by the deadline, we will automatically select meals for you based on your preferences.

3.3 Subscription Changes

You may pause, modify, or cancel your subscription at any time before the weekly cutoff period. Changes requested after the cutoff period will take effect in the following delivery cycle.

Note: All subscription plans automatically renew until canceled by you. You are responsible for managing your subscription settings.

4. Billing & Payments

By providing a payment method, you authorize us to charge all subscription fees to that payment method.

4.1 Billing Cycle

Subscription fees are billed in advance on a weekly, bi-weekly, or monthly basis, depending on your selected plan. Your subscription automatically renews at the end of each billing cycle unless you cancel it.

4.2 Payment Methods

We accept various payment methods, including credit cards, debit cards, and digital wallets. You must provide valid and current payment information. By providing payment details, you represent that you are authorized to use the payment method.

4.3 Price Changes

We reserve the right to adjust subscription prices at any time. We will provide you with at least 30 days' notice of any price changes. Your continued use of the Services after the price change becomes effective constitutes your agreement to pay the new price.

4.4 Failed Payments

If a payment is not successfully settled, we may suspend your access to the Services until we obtain a valid payment method. You are responsible for any fees or charges your bank or payment provider may charge.

5. Delivery Policy

We deliver meals to the address you provide during registration or as updated in your account.

5.1 Delivery Areas

We currently deliver to select metropolitan areas. You can check if we deliver to your area by entering your zip code on our website. We reserve the right to modify our delivery areas at any time.

5.2 Delivery Windows

We deliver on specific days each week. While we strive to deliver within the estimated time frames, delivery times may vary due to factors beyond our control, such as traffic, weather, or other unforeseen circumstances.

5.3 Receiving Deliveries

It is your responsibility to ensure someone is available to receive the delivery or provide appropriate instructions for leaving the package. We are not responsible for meals that are stolen, damaged, or spoiled after delivery if you have provided delivery instructions to leave the package unattended.

5.4 Temperature Control

Our meals are packaged in temperature-controlled containers designed to keep food safe during transit. However, you should refrigerate meals immediately upon receipt. We are not liable for any food safety issues resulting from failure to properly store meals after delivery.

Important: Please inspect your delivery upon receipt. If there are any issues with your order, such as missing items or packaging problems, please contact us within 2 hours of delivery.

6. Cancellation & Refunds

6.1 Subscription Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle, and you will retain access to the Services until that time.

6.2 Refund Policy

We offer refunds under the following circumstances:

  • If your delivery is significantly late (more than 4 hours past the estimated delivery window)
  • If meals arrive in a condition that makes them unsafe or impractical to consume
  • If there are significant errors in your order (missing meals, incorrect items)

Refund requests must be submitted within 24 hours of delivery. We may require photographic evidence of any issues.

6.3 No Refunds

We generally do not provide refunds for the following:

  • Change of mind or dissatisfaction with meal flavors
  • Failure to receive delivery due to incorrect address provided
  • Failure to be available to receive delivery
  • Partial consumption of meals

7. Intellectual Property

The Services and their original content, features, and functionality are owned by AfroFusionPlate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the Services
  • Use our trademarks, logos, or other proprietary information without our express written consent
  • Remove any copyright or other proprietary notices from the Services
  • Reverse engineer, decompile, or disassemble any part of the Services

All meal recipes, nutritional information, and menu content are the intellectual property of AfroFusionPlate and may not be reproduced without permission.

8. User Conduct

When using our Services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any portion of the Services
  • Use the Services to transmit any viruses or malicious code
  • Harass, abuse, or harm another person
  • Use the Services for any fraudulent or misleading purpose

We reserve the right to terminate your access to the Services for violating these conduct guidelines.

9. Liability & Warranty

9.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, AfroFusionPlate DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AfroFusionPlate, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO AfroFusionPlate IN THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

9.3 Food Allergies & Dietary Restrictions

While we take precautions to accommodate dietary preferences and avoid cross-contamination, we cannot guarantee that our meals are completely free of allergens. Customers with severe food allergies should exercise caution and consult with their healthcare provider before consuming our meals.

10. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Services or cancel your subscription through your account settings.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services.
